How to Become a Notary Public in Indiana

Understanding What a Notary Public Does in Indiana

A notary public is an official representative appointed by the state of Indiana to perform specific legal duties. The primary role of a notary is to witness the signing of important documents and verify that the person signing is who they claim to be. When a notary notarizes a document, they are confirming that they personally observed the signer and that the signer appeared to be acting of their own free will, not under duress or coercion.

In Indiana, notaries handle a wide range of documents. Common examples include affidavits (sworn statements), power of attorney forms, loan documents, real estate papers, travel consent forms for minors, and acknowledgments. A notary does not provide legal advice about whether a document is correct or appropriate—that is the responsibility of the document's creator and the person signing it. The notary's role is limited to witnessing and certifying the identity and willing participation of the signer.

Notaries in Indiana are considered ministerial officers, meaning they follow specific procedures set by state law rather than exercising personal judgment about legal matters. This distinction is important because it defines what tasks notaries can and cannot perform. For instance, notaries cannot draft legal documents, interpret contracts, or tell someone whether they should sign something. They can only verify identity, witness signatures, and complete the notarization process according to Indiana Code.

The demand for notary services in Indiana remains steady across many industries. Lenders, real estate companies, government agencies, and the general public all require notarization for various purposes. Some notaries work in banks or law offices as part of their regular duties, while others work independently and charge fees for their services. Understanding the scope of the role helps potential notaries know what to expect before pursuing this credential.

Practical Takeaway: Before proceeding with becoming a notary, confirm that the duties align with your professional goals and available time. Review the Indiana Secretary of State website to read the official description of notary responsibilities and any recent updates to notary laws.

Meeting the Basic Requirements for Indiana Notaries

Indiana has specific requirements that a person must meet before they can become a notary public. These requirements exist to ensure that notaries are trustworthy and capable of performing their duties correctly. The first requirement is that you must be at least 18 years old. This age threshold is standard across most states and reflects the legal assumption that adults have the capacity to hold official positions.

You must also be a legal resident of Indiana or have your principal place of business located in Indiana. "Principal place of business" means where you primarily conduct your work or professional activities. If you work for a company with offices in multiple states but your main office is in Indiana, you would meet this requirement. This residency or business location requirement ensures that notaries have a genuine connection to the state and can be held accountable under Indiana law.

Another key requirement is that you must be of good moral character. While Indiana does not define this phrase with absolute precision in statute, it generally means that you should not have a criminal history—particularly felonies or crimes involving fraud, dishonesty, or moral turpitude. If you have been convicted of certain crimes, this may prevent you from becoming a notary or could result in your commission being denied or revoked. The Secretary of State's office reviews your background as part of the process.

You must also be able to read and write in English. This requirement is straightforward but essential since notaries must complete notarial certificates in English and understand the documents they are witnessing. You should be able to communicate clearly with signers and document what you observe.

Additionally, you cannot currently be disqualified under Indiana law. Disqualifications include previous revocation of a notary commission, a felony conviction (though exceptions may apply after a certain period), or certain other criminal convictions. If you are unsure whether you have a disqualifying condition, you can contact the Indiana Secretary of State's office for guidance before you pursue your commission.

Practical Takeaway: Write down your age, residency status, and whether you have any criminal history. Gather this information before moving forward. If you are uncertain about any requirement, contact the Secretary of State's Notary Division at (317) 232-6531 to ask questions about your specific situation.

Completing the Notary Commission Process in Indiana

The process of becoming a notary public in Indiana involves several steps that must be completed in order. The first step is to obtain a notary application. In Indiana, you can obtain the application form from the Secretary of State's website or by contacting the Notary Division directly. The application asks for basic information about you, including your name, address, date of birth, and details about your residency or business location in Indiana.

On the application, you will need to provide information about your background. You may be asked about criminal history, prior notary commissions, and whether you meet the basic requirements. It is critical that you provide truthful and complete information on this form. Providing false information on a notary application can result in denial of your commission, and in some cases, criminal charges.

You will also need to arrange for a surety bond. A surety bond is a type of insurance that protects the public if a notary commits fraud or makes serious errors in performing notarial duties. The state of Indiana requires all notaries to carry a surety bond. The bond amount is typically $5,000, though this may vary. You can obtain a surety bond from insurance companies or bonding agencies that operate in Indiana. The cost of the bond is usually between $50 and $200, depending on the provider and your creditworthiness. Some companies offer bonds for lower costs if you pay for multiple years upfront.

Once you have your surety bond in place, you will submit your application along with proof of the bond to the Secretary of State's Notary Division. You will also need to pay a commission fee. As of recent years, the Indiana notary commission fee is approximately $25 to $30, though you should verify the current amount on the Secretary of State's website. After submission, the office reviews your application, verifies your information, and processes your commission. This typically takes several weeks.

Once your commission is approved, you will receive your official notary commission certificate. This document confirms that you are a commissioned notary public in Indiana and provides your commission number. You should keep this document in a safe place. In some cases, you may also be required to take an oath of office, which can often be administered by the Secretary of State or another authorized official.

Practical Takeaway: Start the process by visiting the Indiana Secretary of State website (sos.in.gov) to download the current application form and review fees. Research surety bond providers in Indiana and request quotes to understand the cost before you proceed. Allow 4 to 8 weeks for the entire process from application to receiving your commission.

Understanding Notary Training and Education in Indiana

Unlike some states, Indiana does not require notaries to complete a formal training course or pass a state-administered exam before receiving their commission. This means that the path to becoming a notary in Indiana is less rigorous than in some other states. However, this does not mean that education is unimportant. Many notaries in Indiana pursue training on their own to ensure they understand their responsibilities and can perform their duties correctly.

Several organizations offer notary training courses to Indiana residents. These courses cover topics such as notary laws in Indiana, how to verify identity, how to complete notarial certificates correctly, and common mistakes to avoid. The National Notary Association (NNA) is one of the largest providers of notary training and offers online courses that cover Indiana-specific information. Community colleges in Indiana also sometimes offer notary courses. These courses vary in length, from a few hours to a full day, and costs typically range from $20 to $100.

While training is not required, it is highly recommended. Many notaries who have received training report that it helps them understand the legal requirements, avoid costly mistakes, and perform their duties with greater confidence. A notary who makes a significant error—such as notarizing a document without properly verifying the signer's identity—can face civil liability, loss of their commission, or even criminal charges. Training can reduce the risk of these outcomes.

Beyond formal courses, notaries can educate themselves by reading the relevant sections of Indiana Code, particularly IC 30-5-1 through IC 30-5-12, which contain the state's notary laws. The Indiana Secretary of State's office also publishes guidance materials and frequently asked
